Peak Men’s Health - Terms and Conditions

Introduction

Prior to processing your order for prescription medication, we require you to fill out a medical questionnaire. This questionnaire serves the same purpose as a consultation with a medical professional. Our aim is to gain an understanding of your condition, including any current medications, medical history, and any other relevant information that will assist us in determining whether the treatment is both safe and appropriate for your needs.

Our questionnaires are crafted by clinical professionals who adhere to the highest medical standards and regulations, and are customized for particular conditions.

Upon submission of the questionnaire and product selection, and upon payment processing, we will provide confirmation of order receipt and inform you of the expected time needed to review the questionnaire. In cases where a prescription is necessary, we can assist you in connecting with a doctor for a consultation to determine if a prescription is appropriate.

Your order has not been accepted yet, and there is no agreement between us for selling the product until we review your questionnaire and approve you for a suitable treatment. Once approved, our pharmacists will dispense the medication and send it in discreet packaging via Australia Post, according to our terms outlined below.

  1. Ensure that all information provided in the consultation questionnaire or any other form is accurate and truthful to the best of your knowledge. If you encounter difficulty understanding the questionnaire, please reach out to us for assistance. Do not proceed to answer the questionnaire until you have a clear understanding of every question.
  2. It is your responsibility to read the Patient Information Leaflet (PIL) accompanying any medication you buy carefully and follow the instructions provided therein.
  3. It is necessary for you to notify your general practitioner regarding any medication purchased from our website and any potential side effects resulting from its use.
  4. >You acknowledge and verify that the medications being requested are solely for your personal use and should never be distributed or shared with any other individuals.
  5. It is mandatory for you to abstain from utilizing our products or services for any illegal activities. It is also mandatory for you to maintain the confidentiality of your login credentials and not disclose them to any third party.
  6. By agreeing to this, you acknowledge the responsibility to guarantee the safety of deliveries being placed through your letterbox at the delivery address. This includes taking measures to protect children or pets who may be present.
  7. Access to Peak Men’s Health may be suspended or terminated at any time without prior notice if there are reasonable grounds to believe that you have violated any of these obligations.
  8. To ensure safety, only one subscription per product is permitted. We maintain the authority to revoke and reimburse subscriptions in the event we suspect the same individual has initiated duplicate subscriptions.
  9. Using our website or services for emergencies is strictly prohibited. In the event of an emergency, it is imperative that you immediately contact your local emergency department.

     

Terms of Sale

  • The following terms pertain to the provisions under which we provide you with either goods or services, which shall be collectively referred to as "products" throughout this agreement.
  • It is important to carefully read these terms before submitting your order. They provide information on our identity, how we will deliver products to you, how the contract can be modified or terminated, what to do in case of an issue, and other essential details.

  • We are Peak Men's Health, a company registered in Australia under the name CASTLE BASRAY LTD. Our registered office is located at 71 Albert Street, Osborne Park, WA, 6017.
  • To get in touch with us, you have two options: phone or email. Our phone number is 0416 322 316 and our email address is [email protected].
  • We will get in touch with you either by phone or by sending an email to the address you provided in your order, if it becomes necessary to do so.
  • The term "writing" encompasses emails. Whenever the words "writing" or "written" are used in these terms, it is inclusive of emails. 

Our agreement with you

  • When we send you an email confirming that we accept your order, a contract will be formed between you and us. This is how we will accept your order.

     

  • Peak Men’s Health can be ordered by males who are at least 18 years old, residing in Australia, and possess a valid credit or debit card under their name. However, medical approval from a professional may be required. It is not permissible to place orders on behalf of another individual.
  • In the event that we are unable to accept your order, we will inform you and refrain from charging you. This may occur if the product is out of stock, if we detect an error in the price or description of the product, if we cannot meet the delivery deadline, if we do not deliver to your location, or for other significant reasons, such as certain products requiring a prescription that you do not receive after a consultation or if we determine that a product is unsuitable or unsafe for you.
  • An order number will be allotted to your purchase upon acceptance, and we will inform you of the same. Kindly mention the order number while communicating with us regarding your purchase, as it will aid us in providing you with prompt assistance.

Our Products

There may be slight differences between the products and their pictures. The product images on our website are intended for illustrative purposes only. We have put forth our best efforts to accurately display the shape, style, and colours of the products. However, we cannot guarantee that the products will appear identical to the images. Nonetheless, any differences are unlikely to have a significant impact. Therefore, your product may differ slightly from the images presented.

  • The product's packaging might differ from the images displayed on our website. Please note that variations in packaging may occur.
  • Medicines, which may include prescription drugs, are among the products that are available for purchase. For such products, the following supplementary terms are applicable:
  • The Pharmacy we allocate dispenses and delivers these products to you.
  • The Pharmacy is registered and regulated by the Pharmacy Board of Australia through AHPRA as a licensed pharmacy.
  • The online consultations are carried out by independent prescribers who are accredited by AHPRA. They possess the necessary qualifications to prescribe prescription-only medicines within their field of expertise, and their work is reviewed and authorized.
  • To cancel your order, kindly get in touch with our customer service team by calling 0416322316. Please note that our customer service is available from Monday to Friday between 8am and 6:00pm.
  • If the product is not a prescription medicine, you have the right to cancel or return it if you change your mind, regardless of whether there is any issue with the product. More information regarding these rights can be found below.
  • These products are not subject to this policy. Prescription medications cannot be cancelled or returned once they have been dispensed, unless we have made an error. 
  • To properly dispose of medicines, it is imperative that you refrain from doing so in your household and instead bring it back to a pharmacy.

The rights you have to make changes

To request a change to your order, please get in touch with us. We will inform you if the modification can be made. In case it is feasible, we will inform you about any adjustments to the cost, delivery time, or other necessities, and ask for your confirmation to proceed.

Our ability to make changes is within our rights

If it is necessary for us to comply with changes in the law or for the promotion of good health, we may modify the composition of our products or make minor technical adjustments or improvements, such as altering the product's shape or materials used. These changes will not materially affect your use of the product.

Supplying the items

  • Delivery costs will be shown on our website. 
  • Your order will be shipped and delivered within a specified timeframe, unless further action is required from our customer service team. Until then, your order will be considered "pending". 
  • We are not responsible for delays outside of our control. If our supply of products is delayed due to an event outside our control, we will contact you as soon as possible and take steps to minimize the impact of the delay. We will not be liable for delays caused by the event, but if there is a risk of substantial delay, you may contact us to end the contract and receive a refund for any products you paid for but did not receive. 
  • If no one is available at your address to take delivery and the products cannot be posted through your letterbox, we will leave a note with instructions on how to rearrange delivery or collect the products from a local depot. 
  • If you do not re-arrange delivery or collect the products, we may charge you for storage costs and any further delivery costs. If we cannot contact you or re-arrange delivery or collection, we may end the contract and refund you, but may deduct or charge reasonable compensation for net costs incurred as a result. If you do not allow us to perform the services as arranged, we may charge additional costs incurred by us as a result. 
  • If we cannot contact you or re-arrange performance of the services, we may end the contract and you must compensate us for net costs incurred as a result of you failing to allow us to provide services. 
  • You will be responsible for the product once we deliver it to the address you provided or once you collect it from us. You will own the product once we receive payment in full. 
  • We may have to suspend the supply of a product to deal with technical problems, make minor technical changes, or update the product to reflect changes in relevant laws and regulatory requirements. 
  • You may end the contract for a product if this leads to a delay of more than 14 days.

     

Your rights to end the contract

Terminating the contract with us is an option that's always available to you. Your entitlements upon terminating the contract are contingent on various factors such as the product you purchased, its condition, our performance, and the timing of your decision to terminate the contract: 

  • If the product you purchased is defective or inaccurately described, you may have the legal right to terminate the contract, have the product repaired or replaced, obtain a refund, or have the service redone, as stipulated in clause 10;
  • If you're terminating the contract because of something we've done or informed you about, please refer to clause 8.2; 
  • If you've simply changed your mind about the product, please refer to clause 8.3; 
  • If you're within the cooling-off period, you may be entitled to a refund, but this may be subject to deductions, and you'll be responsible for the cost of returning any goods. 
  • Ending the contract due to something we've done or are going to do. If you're terminating the contract for any reason mentioned in (a) to (e) below, the contract will terminate right away. We'll reimburse you for any products that haven't been supplied, and you may be eligible for compensation. The reasons are: 

a) We've informed you about an upcoming change to the product or the terms that you don't agree with (as per clause 6.2). 

b) We've notified you about an error in the price or description of the product you've ordered, and you don't want to proceed. 

c) There's a possibility that the supply of products may be significantly delayed due to events beyond our control. 

d) We've halted the supply of products for technical reasons or have informed you that we'll halt it for more than 14 days. 

e) You have the legal right to terminate the contract due to our wrongdoing.

Australian Consumer Law grants you the right to change your mind within 14 days and receive a refund for most products bought online. This legal right is explained in detail in the terms of the contract. 

  • However, you cannot exercise this right if you have unsealed the product or if it's a medicine, including prescription medicine. Also, the right to change your mind does not apply to services that have been completed. 
  • If you want to cancel your contract, you have 14 days after the day you receive the goods. If it's a subscription that involves regular delivery of goods over a set period, you have 14 days from the date you receive the first delivery of goods. For services, you can change your mind up until the time we have started providing the service. If we have already started providing the services, you can still cancel but must pay for the services provided up to the time you inform us of your decision. 
  • Cancellation must be communicated at least 5 days before the next order to avoid being charged. 
  • If you want to end the contract before it is completed, but we are not at fault, you may have to pay compensation. A contract for goods is completed when the product is delivered and paid for, while a contract for services is completed when we have finished providing the services and you have paid for them. 
  • Promotions can only be used once per individual or household and cannot be combined with each other. They are subject to availability and may be withdrawn or changed to comply with the law or our commercial circumstances.

Instructions for terminating the contract with our company

If you terminate the contract for any reason after the products have been dispatched to you or received, you are obligated to return them to us. You can return the goods in person to the point of purchase, or send them back to us via post or allow us to retrieve them from you (if they are not suitable for posting). If you intend to change your mind, you must dispatch the goods within 14 days of notifying us of your intention to terminate the contract. Contact us to obtain information on where to send the products. Prescription medications must be returned to the pharmacy and destroyed in accordance with pharmaceutical regulations.

The costs of return will be paid under the following circumstances: if the products are faulty or not as described; if you are terminating the contract due to an upcoming change in the product or terms, an error in pricing or description, a delay in delivery caused by external factors, or because you have a legal right resulting from our wrongdoing. We will pay the costs of return promptly.

You are required to cover the direct costs of returning the item unless you are utilizing your right to change your mind. This may include any direct costs incurred by us for collection purposes.

Our refund policy entails reimbursing you the amount you paid for the products, along with the delivery costs, through the payment method you utilized. Nonetheless, we reserve the right to make deductions, which are elaborated below.

In the event that you decide to exercise your right to change your mind, we reserve the right to reduce your refund to account for any decrease in the value of the goods resulting from your handling of them in a manner that would not be acceptable in a retail setting:

  • Should we refund your purchase price prior to inspecting the goods and subsequently discover that the goods were handled in an unacceptable manner, you will be required to remit an appropriate amount to us. 
  • The maximum refund for delivery costs will be equivalent to the least expensive delivery option that we offer. 
  • In cases where you have chosen to purchase a service, we may subtract from your refund an amount corresponding to the duration of the service period that was fulfilled, ending at the moment when you informed us of your decision to change your mind. This amount will be proportional to the portion of the service that was provided in comparison to the full coverage of the contract.

Refunds will be issued promptly. If you decide to exercise your right to change your mind and we have not arranged for collection of the goods, your refund will be processed within 14 days of receiving the returned product or receiving proof that the product has been shipped back to us, whichever comes first. For all other cases, your refund will be issued within 14 days of notifying us of your decision to change your mind.

Peak Men's Health PTY LTD is solely responsible for the provision of the men's health services, advice, prescriptions and any related products offered via this platform.

By accessing or using our services, users acknowledge that all interactions, communications, and transactions occur with Peak Men's Health PTY LTD and not with any individual owner, director, or employee. No personal liability is assumed by any individual associated with Peak Men's Health PTY LTD for the services provided.
